Greetings to Alaskan residents, my name is Stephen Harmon and I am an Alaskan resident and an Alaskan Prisoner housed in Florence Arizona with many other Alaskan prisoners due to supposed over crowding in prisons in the state of Alaska. (Alaskan prisoners including myself were first transferred here January 21, 1995.)

In November – December 1994: Alaska State Officials, (Governor Walter Hickel, Alaska Attorney General Charles E. Cole, Alaska Department of Corrections Commissioner Frank Pruitt, and Alaskan Law Makers, knowingly and openly entered into “ILLEGAL CONTRACT(s)” (to house Alaska State Prisoners due to “Supposed Overcrowding” in Alaska State Prisons) with “Private Citizens that were and are impersonating law enforcement officials (i.e. Prison Guards) and running and operating an illegal company in the State of Arizona, in violation of Alaska Law, in violation of Arizona State Law, and in violation of Federal Law.

WHY IS/ARE THE CONTRACT(S) ILLEGAL:

In 1994 -1995 when the first contract was awarded,

Alaska Law did not authorize any out of state private prison contracts, (all private prison contracts had to be designated for private prison facilities within the State of Alaska only).

 

Alaska laws do not/did not authorize any private prison guards to staff any private prison(s) within the state of Alaska.

 

The State of Arizona did not authorize any private prison(s) to legally operate/exist within the State of Arizona in 1994-1995.

The State of Arizona on April 27, 1997 passed laws to legally authorize private prisons to exist/operate in the State of Arizona: Arizona Revised Statutes 41.1609 to 41.1684; but these new laws only allow for the following:

Arizona State prisoners with Arizona State Department of Corrections staff providing custody and security management, or Federal detainees with Federal Marshals providing custody and security management. (Arizona Laws do not authorize any private prison guards or private correctional officers.  Private prison corporations can only provide the buildings/property, they are not authorized to staff private prisons.)

 

Arizona law requires that any contract to house prisoners from outside of the State of Arizona be originated/obtained through Arizona Department of Corrections subcontracts to private prisons so that oversight is retained by the Arizona Department of Corrections.

 

Arizona and Alaska law requires the use of compacts (western and interstate) to retain legal jurisdiction over state prisoners. Arizona and Alaska have not used those compacts. The State of Alaska admits to these illegal acts in case number A98-288 CV, Olsen v. Corrections Corporation of America, March 28 2000. Alaska continues to violate these laws to date.

 

Arizona law requires that the sending state must notify and get permission from the State of Arizona before transporting prisoners in or out of the State of Arizona.  The State of Alaska has never complied with this law and admits to continued violation of this law in case number A98-288 CV, Olsen v. Corrections Corporation of America, March 28, 2000.

On November 6 1997 at about 0900 to about 1030 FBI Special Agent James Snow of the Phoenix Arizona Office at 201 East Indianola, suite 400, Phoenix, Arizona (602) 279-5511, met with me and stated candidly;

“...Yes Mr. Harmon, what you shared with me is true, private citizens are impersonating correctional officers, and it does amount to them, abusing/molesting children (I.N.S. detainees), abusing/raping females (Federal and Oregon detainees/prisoners) , and assaulting/abusing all male detainees/prisoners. I (Agent Snow) have found nothing legal about this company, nor does it seem/appear that the contracts this company (correctional corporation of America) houses prisoners/detainees under are legal, and any/all deaths of detainees/prisoners in the custody of this corporation amount to negligent homicide...”

In conclusion, if you are an Alaskan resident that does not like or want millions of your state dollars used illegally by your elected representatives, making you a party to ongoing illegal activity. I ask you to contact your elected representatives, Alaskan law enforcement officials and the FBI.  Ask questions, require truthful answers and stop the illegal activity with your state dollars that makes you a party to these illegal activities

 Some suggested questions to ask:

Why is the State of Alaska continuing with illegal contracts to house Alaskan prisoners in private prison facilities outside of Alaska even after you were made aware that the contracts were illegal and consisted of participating in illegal acts?

 

Why were and are millions of my state dollars given to private citizens impersonating law enforcement officials for illegal contracts to house Alaskan prisoners in Arizona?

 

When is this illegal activity with State of Alaska dollars going to be stopped and when are those involved with stealing from State of Alaska funds, making me a party/accessory to these crimes going to be brought to justice?
